Rights of access, rectification, erasure/right to be forgotten, objection, restriction, and portability

The rights of erasure, objection, portability, restriction, access, and rectification guarantee users’ control over their personal data and impose a series of obligations that data controllers and processors must respect.

These rights are regulated by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and Organic Law 15/1999 on Personal Data Protection (LOPD).

What do these rights include?

Right of access:

The citizen has the right to contact the controller of the file in which their data is stored in order to know whether their data is being processed, whether it has been transferred to third parties, and the purpose of such processing.

Right of rectification:

The data subject may ask the file controller to rectify their data if it is inaccurate, incomplete, inadequate, or excessive.

Right of erasure/right to be forgotten:

The data subject may request the deletion of their personal data in the circumstances provided by law.

Right of objection:

The citizen may object to a third party using their personal data in the circumstances provided by law.

Right to restriction:

The data subject has the right to obtain from the controller the restriction of data processing when one of the conditions provided by law is met.

Right to portability:

The data subject has the right to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used, machine-readable format and to transmit that data to another controller without hindrance from the controller to whom it was provided, under the circumstances provided by law.

Please note that in order to process your request, the written request must include:

  • – The right you wish to exercise.
  • – Photocopy of ID or identity accreditation document.
  • – Date and signature of the holder.
  • – Address for notification purposes.
  • – Specific power of attorney if acting on behalf of the data subject.
